菲律賓-起運港裝(zhuang)船前檢驗（LPSR）詳解
一：目的：
1. To further implement AO 234A – 2009 and to streamline existing rules on the requirement for load port survey on imported cargoes;
為了(le)進一(yi)步(bu)落實行政法(fa)令號 234-2009和優化目前(qian)針對進口貨物起運港裝(zhuang)船前(qian)檢(jian)驗的要求(qiu);
2. To promote trade facilitation for cargoes with LPS report by providing an advance clearance system;
通過預清關系(xi)統(tong)，促進經起運港裝船前檢(jian)驗(yan)（LPS）貨(huo)物進口的便利化；
3. To secure advance and reliable information for examination and assessment of cargoes;
為了確保可以預先獲得可靠(kao)的貨物信(xin)息(xi)，對產品(pin)進(jin)行(xing)檢查和評估；
4. To promote revenue protection and to ensure the correct weight, quantity, quality, origin and description of cargoes.

二 COVERAGE 覆蓋產品范(fan)圍
1. Unless exempted under this Order, all bulk, break-bulk, containerized and non-containerized cargoes arriving and entering in any port of entry of the Philippines shall be subject to a Load Port Survey (LPS) at the Port of Origin.
除(chu)非本(ben)發令豁(huo)免(mian)的(de)產(chan)品，其他所有散(san)貨(huo)，散(san)雜(za)貨(huo)，集裝箱(xiang)及非集裝箱(xiang)裝載的(de)貨(huo)物都必須在(zai)，進入菲律賓任何(he)港口前，在(zai)起運港進行(xing)裝船前檢驗(yan)（LPS）。
2.Bulk and break-bulk cargoes may include but are not limited to the following:
散貨和散雜貨包(bao)括以下產品(pin)但不限于以下內容：
1) Liquids液體
2) Chemicals化工品
3) Petroleum Products石(shi)油(you)制品(pin)

3. Imported cargoes surveyed by STEK at the Port of Origin shall be covered by a Load Port Survey Report (LPSR) and Summary Report. The procedures and information needed shall be detailed in the implementing rules and regulations.

4.Cargoes entered into free ports and bound for the customs territory shall be subject to the requirement of LPSR as provided in this Order.

5.Vehicles for special purpose (e.g. cranes, backhoes, bulldozers, ambulances, trucks, buses and the like) entered into the free ports for conversion or retooling, and not previously covered by an LPSR, shall be subject to the conduct of Discharge Port Survey (DPS) prior to withdrawal from the free port into the customs territory. The provision on the imposition of the administrative penalties under Section 8 of this Order shall not apply in this particular case.

三 DESTINATION INSPECTION FOR CARGOES WITHOUT LPSR.

1. All bulk, break-bulk, containerized and non-containerized cargoes not otherwise exempted under Section 4 of this Order and which arrived without the required LPSR shall be subject to a Discharge Port Survey (DPS) to be conducted by the COTECNA.
所(suo)有散(san)(san)裝(zhuang)，散(san)(san)雜貨(huo)，集裝(zhuang)箱以(yi)及非集裝(zhuang)箱貨(huo)物及根據本法令第4條(tiao)規定(ding)的不能獲得(de)豁(huo)免的貨(huo)物，如(ru)果沒有進行LPSR檢驗，必須在目的港(gang)由COTECNA 在卸貨(huo)港(gang)安排檢驗。
2. Any expense or charges arising from the conduct of the DPS on the cargo shall be for the account of the importer. 所有目(mu)的(de)港卸貨港檢驗產生(sheng)的(de)費用將由(you)進口商承(cheng)擔。
3. All Importers who failed to secure a LPSR as required in this Order shall notify the Office of the District Collector of the concerned port prior payment of the applicable fine and the conduct of a DPS for bulk cargoes,. 4. The District Collector concerned shall submit a weekly report to the Port Operations Service (POS), Assessment and Operations Group (AOCG) of all violations of this Order.

四 ADVANCE IMPORT CLEARANCE 進(jin)口預清關(guan)
1. All cargoes covered by an LPSR shall be automatically exempted from physical and x-ray inspection, except in instances:
通過裝船前(qian)檢驗LPSR的貨物，自動免除海關和X-Ray掃描儀檢驗，除非
a. The LPSR has been tampered or shows signs that the same has been tampered;

b. The shipments is covered by an alert or hold order;

c. The importer disagrees with the findings of the LPSR and requests that a DPS be conducted in the presence of customs officers; and

2. In addition, BOC shall provide for the procedures to allow the filing and clearance of import entry declarations even prior to arrival of the goods under conditions to be provided in the implementing rules and regulations.

五(wu) CARGO SURVEY FEES. 貨物檢驗費(fei)
COTECNA shall be allowed to charge fees payable by the exporter, unless otherwise agreed upon by and between the importer and exporter, and as provided in the rules issued by the Committee on Accreditation of Cargo Surveying Companies (CACSC).
檢(jian)驗(yan)費用由出(chu)口商支付給檢(jian)驗(yan)公司，除非(fei)進口商和出(chu)口商之間(jian)另有約(yue)定，并根(gen)據檢(jian)驗(yan)公司認可委員會（CACSC）頒布的規則(ze)規定。

六 VIOLATION AND PENALTIES. 違(wei)規和處罰
1. It is the duty of importers and consignees to make sure that their cargoes undergo the required LPS, with the corresponding LPSR issued. All importers who failed to secure a LPSR for their imported cargoes shall be accept the corresponding administrative punishment
作為進口商和(he)收貨人的(de)(de)責任，必須確保貨物(wu)在起運港進行裝船(chuan)前檢(jian)驗(yan)，并取得(de)相應(ying)的(de)(de)LPSR證書。所有的(de)(de)進口商沒有獲(huo)得(de)LPSR證書，進口的(de)(de)貨物(wu)須接受相應(ying)的(de)(de)行政處罰(fa)。
2.The imposition of any fine or penalty under this Order shall be without prejudice to the imposition of applicable administrative and criminal penalty arising from any finding of violation of other customs laws, rules and regulations as a result of the conduct of the DPS or the physical inspection. 根據本法(fa)令的實施(shi)任(ren)何(he)罰(fa)金或(huo)處罰(fa)，不影(ying)響任(ren)何(he)違反其他(ta)海關法(fa)律，法(fa)規和(he)規章所實施(shi)行政和(he)刑事處罰(fa)。
